FTC Final Disposal Rule – Hard Drive Destruction

If your company donates old PCs containing hard drives to a computer recycler…instant data breach!   Why?  The FTC Final Disposal Rule.

Any business or individual who uses a consumer report – most employees use credit reports to vet employees – is subject to the requirements of the Disposal Rule which calls for the

proper disposal of information to protect against “unauthorized access to or use of the information.”  In addition, businesses must perform due diligence on their data destruction vendors:

  1. Review an independent audit of the disposal company’s operations and/or its compliance with the Disposal Rule
  2. Obtain information about the disposal company’s references
  3. Review and evaluate the disposal company’s information security policies and procedures
  4. Require that the disposal company be certified by a recognized trade association

Organizations must be able to defend their decisions with documented vendor qualifications and selection criteria; “I gave the PC to a company for recycling” is not sufficient.
